Regulations of the JSCREATOR.PL online store

Article 1. General provisions

  • The order in the online store jscreator.pl (hereinafter referred to as the "order") defines the rules of shopping in the context of the online store, which is available in the domain jscreator.pl (hereinafter referred to as "JSCREATOR") and the provisions of services on the Internet in the field of account management referred to in art. 2 point 5.
  • The seller is JSCREATOR based in Poland in Szymanowo (63-900) at ul. Radosna 28, NIP: 6961597700 and REGON: 300743714.
  • To use jscreator.pl, a device with an internet connection, a standard operating system and a standard browser is required.

Article 2. Customers and registration

  • Customers of jscreator.pl) (hereinafter referred to as “customers”) may be these persons who are at least 16 years old and have the ability to do business in such an area so that they can successfully buy a certain product.
  • To make it easier to use jscreator.pl, a customer can register (create an account) by filling out an electronic form jscreator. pl by providing such data as email address, password, first name, last name, address and telephone number. Creating and using an account is free of charge. You don't need to create a customer account to buy something.
  • After the correct registration, a customer will have access to his account, which he can use within the scope of jscreator.pl if he provides an email address or when registering.
  • Contract for electronic services in the field of account management is concluded between a customer and seller at the moment when the customer gains access to the account created by him.
  • Account contains data of a customer, which he entered in the registration form and history of his purchases in the context of jscreator.pl. In the event of any changes to the data specified in the account, the customer is obliged to update them immediately using the appropriate form on the website jscreator.pl. The customer is liable for incomplete, out-of-date or incorrect data or no corresponding update of his data.
  • The customer cannot make his account available to other people, including his login password. The customer is obliged to keep his account password secret and to protect it from publication. The customer must report jscreator.pl immediately if his access data has been given to third parties and he must explain the circumstances of this situation.
  • Customers who do not have a registered account must provide delivery addresses when making purchases, i.e. First name and surname of the recipient - for the purpose of realizing the sales contract as well as e-mail address and telephone number - for contact when realizing the delivery.
  • In the event that the use of jscreator allows the disclosure of third party data (e.g. for recommendation purposes), the customer will only disclose such data if the use of third party data complies with the legal requirements (e.g. he has a license from a data subject necessary permission to use the data at jscreator.pl), in the event that he provides data without permission, he is liable for this action.
  • In the event that the customer acts contrary to order, legal regulations or good manners, the seller may terminate a contract with the customer or interrupt its execution in the context of the specified account. This particularly affects the situation if the customer has downloaded or used the materials made available within the scope of jscreator without the consent of the seller.
  • Any aggregation and processing of the data or other information that is available at jscreator so that it can be made available to third parties as part of other Internet services, as well as outside of the Internet, is prohibited. It is also forbidden to use the name JSCREATOR, including characteristic elements of the graphic without the permission of the seller or other subject who may grant such permission.
  • An account is managed indefinitely for the benefit of a customer. The customer can at any time request that his account be deleted by filling in an appropriate electronic form that is located at jscreator. The customer may also request that his account be deleted in another way if his identity can be verified as possession of the account. Regardless of the situation mentioned above, a customer who has registered but did not buy or did not use any of the seller's electronic services within the framework of jsreator.pl may withdraw from the contract concluded in this way without giving any reason, within 14 days of that Day on which he registered.

Article 3. Purchases

  • As part of jscreator.pl, information about products (hereinafter referred to as "products") as well as purchasing and delivery conditions are published. For the avoidance of doubt, this information is not an offer, but only an invitation to make offers with content that is contained in information about the product. The choice of products from a customer and confirmation of the willingness to buy is an offer when it comes to concluding the sales contract for the products (hereinafter referred to as "order").
  • The seller reserves the right that photos of products are only examples and serve to represent specific products. Differences result from individual settings of a computer or other device that the customer uses when making purchases
    (Color, dimensions, proportions, etc.) must not be the basis for complaints about a product.
      
  • The customer selects products by adding selected products to a (virtual) shopping cart. Adding the products to the shopping cart does not mean reserving these products. In the event that the number of available products is used up before the customer confirms them, the seller reserves the right not to place an order.
  • After choosing the products, but before choosing the form of payment, the customer must provide the full and correct delivery address and telephone number, which must not change until delivery. Changing the delivery address is only possible in special cases after the agreement with the seller and before the products have been passed on to the carrier so that they deliver.
  • After placing the order and choosing the payment method, the customer receives an email from the seller confirming that the order has been placed. When the seller receives an order, the customer receives a corresponding message. At the moment when the customer receives such a message, a sales contract between the seller and the customer is concluded. In the event that only part of the order has been confirmed, a contract has only been concluded for confirmed products. In the event that the customer does not want to conclude a contract for only a part of products, he may withdraw from the contract, however not later than within 14 days after receipt of the purchased products.
  • If the seller is unable to provide all or part of the service because a product is no longer available or has not been delivered to the seller in unexpected circumstances, or has been damaged or lost, the seller shall immediately inform a customer and give him paid Price back or proposes a service with the same value according to the choice and with the permission of a customer.

Article 4. Payment

  • Payment is made by the customer to the account number provided or using electronic payment methods provided by the specialized payment institution with which the seller has entered into a contract so as to provide convenience for his customers.
  • If the products are not paid within 7 days of the day the order is placed, a customer's order will be canceled and no payment will be considered a withdrawal from the sales contract.
  • Price does not include transportation and delivery costs, which are calculated separately.

Article 5 Delivery of products

  • A place where a performance of the sales contract is provided by the seller is a place where a product is received (in case of doubt, a place where a product should have been received from a customer according to the information).
  • The seller informs customers about delivery costs on the jscreator.pl page and in a summary of the order before it is placed by a customer.
  • The delivery time of the ordered products can be found in the summary of the order. The specified delivery time includes working days. If a customer ordered several products in one order and these products have different delivery times, they will be delivered after the collection of all products, i.e. according to the longest delivery time of the individual product.
  • Delivery of the products takes place only to the following address, which is located in the area of the Republic of Poland, but also in countries for which the seller determines separate delivery costs. Sellers, if possible and subject to the separate agreement, may send products to countries other than those specified by jscreator.
  • Products are transported by specialized transport companies, a list with the regulations of the services of the individual transport companies can be found on the website jscreator.pl. The seller informs a customer about details of the delivery, in particular about which transport company delivers his order, including the link for tracking the shipment.
  • The customer must check the condition of the product immediately after receipt or, if it becomes impossible, the condition of the packaging. In the event that any damage is found during transport, the customer should draw up a corresponding report and inform the seller immediately.
  • The seller is not liable if the product was not delivered for reasons on the part of the customer - e.g. if he has given incorrect and no complete delivery address, which makes delivery impossible. In such a case, the seller will inform a customer of a failed sample delivery of products.

Article 6 Protection of personal data

  • The seller is the administrator of personal data of the customer or persons who have been provided by the customer.
  • Personal data is processed by the administrator in accordance with legal regulations and only for the purposes associated with his activity, including the conclusion and implementation of sales contracts (handling the transaction of product sales, communication with customers and checking complaints), but also archiving the transactions ,
  • Personal data are processed on such a basis: a) the customer accepts a service or sale, b) it is necessary to implement the contract in favor of a customer c) administrator has a legitimate interest (e.g. defense of claims or, in the case of data of third parties, by the Customers will be given - the delivery address of another person).
  • The submission of personal data is voluntary, but no submission can complicate or render impossible the provision of services, sales or service after the sale
  • Personal data is kept for a period of time necessary to place an order or to manage a jscreator customer account. After this period, personal data may be processed on the following basis: legal obligations of an administrator (e.g. in the area of storing book documents) or legitimate interest (defense of claims against administrators).
  • Administrator guarantees the person whose data he is processing, realizing the authorizations that result from legal regulations, including the right to access his own personal data, correction, modification, deletion or transfer, as well as the right to restrict the processing of personal data or to file an objection against this processing according to rules established in certain regulations. In addition, in the event that permission to process the data has been given voluntarily, every data subject has the right to withdraw the permission to process the data. Every data subject has the right to lodge a complaint with the Inspector General for the Protection of Personal Data.
  • Personal data relating to customers or other persons specified by the customer are protected by the administrator from access by unauthorized persons, but also from other cases in which they disclose or the specified data and information are modified in an unauthorized manner.

Article 7. Complaint procedure

  • A customer may submit a complaint to the seller, especially in the event that a product does not comply with the contract or has defects, but also if the seller's actions are incorrect or improper.
  • A complaint can be submitted online using a contact form on the jscreator.pl website, by email or in writing to the seller's address.
  • A complaint should contain the following information: first name and surname, contact details (given in jscreator.pl), description of a transaction that is at stake, or other circumstances that justify the complaint, but also specific requirements of a customer related to the complaint are connected. In the event that a complaint concerns a product, you must also return a product that is the subject of a complaint, along with the submission of a complaint, and confirmation of the purchase.
  • If the data or information provided in the complaint should be supplemented, the seller will contact the customer who is filing the complaint with the request for supplementation to the extent necessary.
  • The seller deals with such a case within 14 days from the day on which he received a correctly prepared complaint, in the case of a complaint about a purchased product, within 14 days from the day on which he gave the product with a precisely described cause of the Complaint received. The customer will receive information about how to check the complaint online, to the address that he provided when registering, or in writing. In the event that a complaint is rejected, the customer will be informed by the seller and the seller will give reasons for this.
  • If a replacement or repair of a product becomes possible, the seller informs the customer and he also informs him about all steps of the further process. In the event that the refund of the price is confirmed, the amount will be refunded within 14 days from the day the seller received the product.
  • The seller does not accept cash on delivery items.
  • The customer may appeal against a decision of the seller regarding a complaint.
  • Repayment of the price a customer pays was done in the same way as payment for a product.
  • The customer, who is a consumer, can use extrajudicial ways to review complaints or assert claims, including:
  • He may report a dispute to the Consumer Arbitration Court, which acts at the commercial inspection, by requesting a decision in that dispute;
  • He may contact a voivodeship inspector of the trade inspection with the request to start the mediation process if the dispute is valid;
  • He is entitled to free help in the extrajudicial examination of the disputes or in the assertion of claims by consumer associations in the district (city) or social organizations whose statutory duties include consumer protection;
  • He may use a European platform ODR (Online Dispute Resolution), which can be found at the following address https://ec.europa.eu/consumers/odr/

Article 8. Withdrawal from the contract

  • A customer may withdraw from the contract within 30 days of receiving the product without giving any reason. Withdrawal from the contract may be made using the contact form on the website jscreator.pl or in writing. In the event that, in the context of an order, a customer bought more than one product, withdrawal from the contract may affect all products or a selected product, subject to the condition that in the event that a product is sold as a set or package, one may only withdraw from this set or package.
  • In the event of a successful withdrawal from a sales contract, a contract is deemed not to have been concluded in relation to a product (set, package) from which a customer has withdrawn. The product should be in its original packaging, with complete equipment and accessories. Returns should occur immediately, no later than within 14 days from the day the customer received the product. The customer bears the cost of returning the product to the seller. In the event of a successful withdrawal from a sales contract, the seller will refund an amount for the product in the same way as the payment for the product.
  • In the event that a withdrawal period is exceeded, the seller will send the returned product back to the customer at his own expense. If a customer does not follow the procedure for withdrawing from a contract described above, this can result in a substantial delay in the termination of the procedure in the area of withdrawing from a contract, and thereby repayment of the amount to which the customer is entitled.
  • The right to withdraw from a contract does not apply in cases determined in Article 38 of the Consumer Rights Act of May 30, 2014, especially in the case where a service item was manufactured according to the requirements of a customer or serves to meet individual needs ( For example, products that contain a designation that a customer orders.)

Article 9 Final provisions

  • In the event that the following order changes, jscreator.pl will inform its customers on the jscreator.pl website. Order enters into force on the day that is found in change no earlier than 7 days after publication by the seller, with the proviso that technical and information changes, or those that may not aggravate the situation of customers, may come into effect earlier , For customers who place an order before a new order comes into force, the previous order applies.
  • It is forbidden to use the name JSCREATOR, including characteristic elements of the graphic without the permission of the seller or other subject who may grant such permission.
  • The corresponding right for sales contracts between a customer and a seller, under certain conditions, is Polish law. All disputes arising from the application of this order will be decided by ordinary Polish courts.
